Following recent changes in the law, as soon as a you (a tutor) works with other tutors you will be regarded, in law, as a Tutor Agency. This applies whether you employ tutors or work with other self‑employed tutors. The only exception is where you simply suggest names of tutors to clients (for example, a client asks you to recommend a GCSE Foundation Maths tutor and you provide three names), and absolutely no payment or benefit passes between you and the tutors. In all other cases, you will be treated as a Tutor Agency.
As a Tutor Agency, to comply with your legal requirements you must now operate either as
- an employment business or
- an employment agency.
The correct model depends on how you work:
- If the client contracts with you (for example, your agency is paid by the client, you then pay the tutor, and the client can contact either you or the tutor for queries such as rearranging sessions or requesting updates), then you are operating as an employment business.
- If you introduce the client to the tutor and the client then forms a direct relationship with the tutor (for example, the client pays you for the introduction and pays the tutor directly for the tutoring and all queries must be directly with the tutor), then you are operating as an employment agency.
It is vital to have agreement/terms with tutors, including self-employed tutors, and your clients, whichever model you choose. Failure to do so will lead to issues, including potential issues with HMRC.
